Tier 4 General Student Visa is the category that allows overseas students to come to the UK and study. It is fact that the UK has a long and well-known educational history.  Students from almost every country have heard of Cambridge and Oxford.  However, other universities in the Russell Group such the London School of Economics and Political Science, University of Bristol, and Durham University are also world-renowned.  In addition, there are an abundance of technical colleges and other higher education providers located throughout the country.

To enter the UK on a student visa, some tough requirements need to be met.  However, recognising the enormous contribution international students make to the UK, not only economically, but culturally as well, the government is testing a scheme to make it easier for students to enter the UK.

Every year, many students come to the UK and acquire prestigious degrees. In 2015/16, 14% of students studying at higher educational institutes were from outside the EEA. Our expert immigration advisors assist students and academic institutions on all student visa matters and have a high rate of success with even the most complex applications.


Who Can Apply for a UK Tier 4 General Student Visa?

To apply for entry to the UK on a student visa, you must be:

  • An overseas student who wants to study in the UK, or
  • Already in the UK, and wishing to remain in the UK to study, or
  • Already in the UK and wanting to switch to the Student Visa category

What Are the UK Tier 4 General Student Visa Eligibility Requirements?

You must meet the following criteria to successfully apply for a Tier 4 Student Visa:

  • Have been offered a place at a UK higher educational institution which is a licensed Tier 4 Sponsor
  • Have a CAS (Confirmation of Acceptance for Studies) number from your UK educational institution
  • Meet minimum financial requirements to live, pay tuition, and cover expenses while in the UK
  • Have proof of English language proficiency (there are some exceptions):
    • Nationality from an English speaking country, or
    • An accepted English language degree, or
    • Successfully passing an accredited English language test

In addition, your course must meet the criteria.  You can attend the following on a Tier 4 (General) Visa:

  • a full-time course that leads to at least a Level 6 qualification on the Ofqual register
  • a part-time course leading to at least Level 7 on the Ofqual register
  • a foreign course of degree level study that’s equal to a UK higher education course and is being run by an overseas higher education institution
  • a full-time course, with at least 15 hours per week of organised daytime study, leading to a qualification which is at least Level 3 on the Ofqual register
  • a recognised foundation programme as a postgraduate doctor or dentist

What Documents Are Required for a Tier 4 General Student Visa?

To successfully apply for a Tier 4 Student Visa, you will need to submit the following (a non-exhaustive list of) documents with your application:

  • your passport or other valid travel document
  • CAS (Confirmation of Acceptance for Studies)
  • proof (in the form of bank statements or other financial documents) that you can pay for your course fees and support yourself throughout the time you spend studying
  • proof that your parent or guardian consent to you coming to the UK if you are under 18 years old, proof of your relationship with your parent or guardian
  • the results of your Tuberculosis test if you are required to have one

The Advantages of Having a Tier 4 General Student Visa

• There are many service providers who can assist in setting up a UK based company easily with a reasonable fees.

• This is a required step, and it is advisable to do so anyway as it keeps business money separate from your own funds
• You may find it easy to open business bank account with many digital banks such as Tide, Monzo, Starling  with compare to typical high street banks

• In order to start trading the UK, you must register your business with HMRC and file your tax returns in order to pay corporation tax
• You may also have to register for VAT depending on the types of goods or services you sell, where you offer them and the amount of VAT taxable turnover you have

• There are several types of business insurance that may have to acquire in order to start a UK business 
• If you have employees, you must get Employer’s Liability Insurance, which covers claims made by your employees against your business if they become ill or injured whilst working 
• It is also a good idea to get Public Liability Insurance, as this will protect your business if you cause injury to a third party
• Professional Indemnity Insurance will protect your company against financial and reputational harm if your company makes a mistake whilst working for a customer

Hello and welcome to today’s video on how to apply for indefinite leave to remain, which is also known as settlement,

00:00 Introduction 
Acquiring ILR allows you to remain in the UK permanently without the need for sponsorship 
There are several different routes to achieving ILR, from a three-year route on a Global Talent visa to a 10-year route on any visa, but in this video, we will be focusing on one of the most common pathways, which is applying after living here for five years on a Skilled Worker visa.

00:48 Agenda 1 – Eligibility 
• In order to be eligible for ILR, you must have lived and worked in the UK for five years on an eligible visa (we will discuss absences later in the video)
• You must also meet the usual Skilled Worker salary requirements, both when you apply and after you get ILR
• You must prove your knowledge of the UK by passing the Life in the UK test
• You must also show knowledge of English language – this will have been done already as part of your Skilled Worker visa application, but if you are applying as a dependent who has not previously proven it you will need to prove this for your ILR application 

01:22 Agenda 2 – Documentation
• All the passports you have held during your time in the UK 
• Current and expired BRPs (wherever available, applicable)
• Life in the UK test certificate number 
• Letter from your employer that confirms that your employment is still required and that you have been paid and will be paid the requisite amount for your role
• Your payslips and bank statements as proof that you have been paid at least the minimum salary threshold 
• Cohabitation evidence – only if you are applying as a dependant; you will be asked to prove that you have lived with the main applicant for the preceding two years, you can send evidence such as utility bills and bank statements to prove this
• Absence spreadsheet – not mandatory, but can be helpful to show you have never gone over the limit 

02:23 Agenda 3 – Absences
• You cannot have spent more than 180 days outside of the UK in any 12-month period
• If you are close to the limit, you should remember that the day you arrive back in the UK does not count as an absent day, which is a common mistake made by ILR applicants
• At A Y and J, we have an absence spreadsheet that automatically calculates the total number of days of absence over a certain period, which we can use to confirm that you have not gone over the limit 

02:56 Agenda 4 – Timeline and Fees
• You can apply 28 days before you have been in the UK for five years 
• This application costs £2,885 per applicant at the time of the publication of this video.
• The normal timeline is six months to get a decision
• You can pay a priority service fee of £500 to get a decision in five working days after providing biometric information, and £1,000 for super-priority to get a decision in one working day

00:00 Introduction
Acquiring ILR allows you to remain in the UK permanently without the need for sponsorship
There are several different routes to achieving ILR, from a three-year route on a Global Talent visa to a 10-year route on any visa, but in this video, we will be focusing on one of the most common pathways, which is applying after living here for five years on a Skilled Worker visa.

00:48 Agenda 1 – Eligibility
• In order to be eligible for ILR, you must have lived and worked in the UK for five years on an eligible visa (we will discuss absences later in the video)
• You must also meet the usual Skilled Worker salary requirements, both when you apply and after you get ILR
• You must prove your knowledge of the UK by passing the Life in the UK test
• You must also show knowledge of English language – this will have been done already as part of your Skilled Worker visa application, but if you are applying as a dependent who has not previously proven it you will need to prove this for your ILR application

01:22 Agenda 2 – Documentation
• All the passports you have held during your time in the UK
• Current and expired BRPs (wherever available, applicable)
• Life in the UK test certificate number
• Letter from your employer that confirms that your employment is still required and that you have been paid and will be paid the requisite amount for your role
• Your payslips and bank statements as proof that you have been paid at least the minimum salary threshold
• Cohabitation evidence – only if you are applying as a dependant; you will be asked to prove that you have lived with the main applicant for the preceding two years, you can send evidence such as utility bills and bank statements to prove this
• Absence spreadsheet – not mandatory, but can be helpful to show you have never gone over the limit

02:23 Agenda 3 – Absences
• You cannot have spent more than 180 days outside of the UK in any 12-month period
• If you are close to the limit, you should remember that the day you arrive back in the UK does not count as an absent day, which is a common mistake made by ILR applicants
• At A Y and J, we have an absence spreadsheet that automatically calculates the total number of days of absence over a certain period, which we can use to confirm that you have not gone over the limit

02:56 Agenda 4 – Timeline and Fees
• You can apply 28 days before you have been in the UK for five years
• This application costs £2,885 per applicant at the time of the publication of this video.
• The normal timeline is six months to get a decision
• You can pay a priority service fee of £500 to get a decision in five working days after providing biometric information, and £1,000 for super-priority to get a decision in one working day
