Today, I am going to talk about our Case Study on a Sponsor Licence Application.
A well reputed London based Architecture firm was looking to sponsor a NON-EEA Tier 4 student who was working for the company part time. The firm wished to employ him on a permanent basis because the firm was concerned that it could not continue the project they took on or they could not take on new projects as the skills that Non-EU national employee had were rare.
The Firm had to obtain a Sponsor Licence to sponsor this NON-EU skilled staff. They were concerned about the time line, process and compliance obtaining Sponsor Licence.
Now, before we discuss as to how we helped this company let me highlight few general points for the company obtaining Sponsor Licence.
The majority of Sponsors are facing great difficulties when sponsoring Tier 4(General) students, despite the fact that they are exempt from the Resident Labour Market Test (RLMT). Most of the Sponsors when applying for licence, they cannot outline the reasons as to why their Tier 4 candidate if best to fill in the position they require within their company, and as a result, they fail to satisfy that they have a genuine vacancy. Most of the Sponsors receive compliance visits from the Home Office and further enquirie, and few of them manage to pass the Home Office rigorous assessment without legal advice. Therefore, if a Sponsor fails to satisfy the compliance officer of an adequate HR system and a genuine vacancy then their application will be refused and a cooling off period of 6 months would apply to them, this means company cannot reapply for next six months.
So, the Architecture firm who was looking to take on board a Tier 4 (General) Student – a skilled architect, engaged our services.We assisted with the preparation of their Sponsor Licence Application and helped them to refine their HR system to be compliant, should a Home Office visit ever occur. Within less than two months from the submission of their Sponsor Licence Application, The company received Licence WITHOUT the Home Office visiting their premises or requesting for further evidence.
