Mr V is a PhD graduate and founder of an amazing UK business. He was recently given the opportunity to invest funds totalling £200,000 into his UK business, and he needed to qualify for a Tier 1 (Entrepreneur) visa in order to grow the company. Mr V had no finances of his own—the funds were provided from an outside source. With a background in research, he also lacked the experience required by UKVI to receive a Tier 1 (Entrepreneur) visa for his UK business.
Mr V travelled to the UK on various occasions over the course of many months, investigating how he could return to the UK as a Tier 1 (Entrepreneur) Migrant to run his established business. He approached numerous law firms for help but was told that the way he was looking to invest the £200,000 into his UK business was not viable and he would be denied if he submitted an application.
Mr V’s partner approached our firm and explained his desire to bring his business partner to the UK. Having received various discouraging opinions, he was not sure of their chances for success.
Our specialist team took detailed instructions, and through extensive research, we were confident that Mr V had a strong possibility of entering the UK on Tier 1 (Entrepreneur) visa. We concluded that the best route for Mr V to return to the UK was to provide evidence of his investment of £200,000 via share capital and apply for entry clearance relying on the previous investment made into a UK company less than 12 months since submission of his entry clearance application.
This case was unique because the company had been established for less than 6 months prior to submitting Mr V’s entry clearance application as a Tier 1 (Entrepreneur) Migrant, and investing the funds via share capital was made just weeks before.
The other challenge we faced was ensuring Mr V would successfully pass the interview with the Home Office as part of the genuineness test. We prepared a mock interview and ensured that every aspect of his business plan and documents were covered. The confidence this preparation gave Mr V not only helped him to answer over 70 tricky questions while being interviewed by the Home Office but ensured he was granted entry clearance as a Tier 1 (Entrepreneur) Migrant.
Our specialist team at A Y & J Solicitors ensured that Mr V was successful in his application. We outlined the requirements and specified documents Mr V was required to provide, set out a timetable to expedite the process, planed and maintained contact with his accountant, and prepared him thoroughly for his interview with Home Office. A Y & J Solicitors also communicated with UKVI to arrange for the interview and kept in contact with the relevant department from Home Office until Mr V received a favourable decision on his application.
In less than three months from the time Mr V began working with us we helped him obtain his Tier 1 (Entrepreneur) visa.
