Background:
Medical conditions are difficult to deal with but without the support of family members it can be extremely daunting. We understand the importance of having family present at such a crucial time in one’s life.
We were contacted by Mrs P, a USA citizen who had entered the UK with a valid visit visa to visit her daughter who was living in the UK with a skilled worker visa. Once in the UK she quickly fell ill and after undergoing checks it was found that she had chronic liver cirrhosis. The applicant was unfit for travel and required palliative care in the UK but was unable to receive the same due to her visa status.
Time was limited and it was imperative to have the application submitted and granted quickly.
The Challenge: The main challenges in this case was to first prepare the application quickly but ensure there was adequate supporting evidence and legal representations, secondly, the applicant, due to her health, was unable to attend a biometric appointment.
With the above in mind, we liaise with the applicant’s daughter to obtain all the relevant documents and prepare the application.
How We Helped: Acting quickly, we completed the online application, gathered all possible medical information, and then drafted extremely detailed legal representations detailing all the medical conditions, complications, and what exactly this means for the applicant. We also highlighted the need for the application to be expedited.
Once submitted, we liaised with the biometric exemption team and arranged for a team to visit the applicant at her home and conduct the biometric appointment.
The main focus was to highlight exactly how serious the medical conditions were, the impact on the applicant, and the need for the application to be granted to allow her access to urgent medical treatment.
We ensured we kept the applicant and her daughter informed throughout the process, so they had one less thing to worry about, during this already stressful period.
The Result: Due to the amount of care and attention that went into preparing this application, the applicant was granted leave outside of the rules, meaning that she was able to get the care and support she needed in the final stages of her life. It was a pleasure and honour to be trusted with such an important application and we were grateful to be able to secure a positive result for the applicant.
