ILR Mistakes That Can RUIN Your 2026 Settlement

A Y & J SolicitorsFebruary 12, 2026 4:29 pm

Everyone is asking the same question about UK citizenship right now. If you qualify before the new rules come in, will the changes still affect you? Here is the truth most people are missing. If you already have Indefinite Leave to Remain, you are currently safe. The proposed changes focus on how people reach ILR, not what happens after. But there is a catch. The government has confirmed that citizenship timelines and requirements will change for future applicants. That includes tougher Life in the UK tests and higher English language requirements moving from B1 to B2. If you already have ILR and will be eligible for British citizenship within the next 12 months, this is the window to act. Waiting for consultations or announcements could cost you time or eligibility. If you are married to a British citizen, you can apply immediately after ILR. Everyone else must wait 12 months. That rule has not changed yet, but major reforms are expected in 2026. UK Settlement: 3 Groups NOT Stuck in the 10-Year Rule

A Y & J SolicitorsDecember 4, 2025 1:54 pm

Shabana Mahmood’s recent comments in Parliament have shaken almost every Skilled Worker, care worker and visa holder waiting for ILR in the UK. This video breaks down the new ILR changes proposed for 2025 and 2026, what the “earned settlement” system really means, and whether the 10-year plan will apply to people already living in the UK. If you’ve watched TikToks and YouTube creators saying different things, this is the calm, clear explanation you needed. Below are the major sections from the video. 1. 0.01 - What Shabana Mahmood Said About ILR Changes 2. 0.51 - What the New ILR Proposal Actually Is 3. 1.24 - How are the New Rules Different from the Current Rules 4. 1.42 - How Income and Skill Level Change Your ILR Timeline 5. 2.16 - ILR Fast Track Reductions Based on Income 6. 2.57 - The 15-Year Risk for Care Workers 7. 3.40 - How Benefits, Debts and Public Funds Affect ILR 8. 4.26 - What Happens to the 10-Year Long Residence Route 9. 4.58 - What can you do now? A Practical ILR Action Plan for 2025 Applicants 10. 5.16 - How to Get Personal ILR Advice About this video This is a full breakdown of the UK ILR New Rules 2025, based on: The official Home Office consultation Shabana Mahmood’s parliamentary debate Explanation of all the proposed changes. If you are a Skilled Worker, Health and Care Worker, dependant, or a student planning to switch, this video gives you the six facts you must understand before planning ILR in 2025 or 2026. Use our ILR Eligibility Assessment Tool to get instant insight into your eligibility and the key requirements. The requirement is to demonstrate a genuine and subsisting relationship of at least two years. Where a couple has not lived together (for example, due to cultural or religious reasons that do not allow cohabitation before marriage), this should be clearly explained and supported with alternative evidence. -For in-country partner applications, the correct technical term is FLR(M) – Further Leave to Remain as a partner. Rather than saying “most people call it FLR(M)”, it is better to state that this is the formal name of the application. -For the financial requirement met through cash savings, please make it clear that joint savings can be used even when applying from outside the UK, provided the funds meet the Home Office rules on amount, ownership and the 6-month holding period. ---------------------------------------------------------------------------------------------------------------- DISCLAIMER: THIS INFORMATION IS FOR EDUCATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL LEGAL ADVICE. Additional Clarification from A Y & J Solicitors:

-For unmarried partners, the Immigration Rules do not strictly require that you have lived together for two years.
