It is important to make sure that when you are ready to apply for British citizenship, you meet the criteria. Unfortunately, even a prolonged absence from the UK may mean that you are not eligible. This is why we recommend understanding and maintaining your eligibility for British citizenship throughout your time in the UK. In this article, we will explain how to maintain your eligibility for British Citizenship so you can be confident that when you apply, you will be approved without delay.

What are the criteria for British citizenship?

To maintain your eligibility for British citizenship, it is essential to understand the eligibility requirements laid out by the Home Office. The exact requirements that you need to meet will depend on how you are eligible for British citizenship (e.g. through ILR, being born in the UK, being born outside the UK to British parents, or another route).

The eligibility requirements are intended to ensure that applicants are genuinely committed to integrating into British society and contributing positively. The key criteria include:

  • Continuous residency and presence in the UK

Additionally, you must have spent no more than 450 days outside the UK during this period and no more than 90 days outside the UK in the last 12 months before applying.

From when you first arrive in the UK, you make sure that any time you spend outside the UK is within the allowed time. This is why we highly recommend keeping a record of your travel dates and durations (including copies of documents, tickets, expired passports, and entry/exit stamps). It is also useful to create a spreadsheet of all of your entry and exit dates so you can keep an accurate tally of your time outside the UK.

We also recommend keeping any records that demonstrate your ties to the UK, such as property ownership (mortgage documents), employment (employment contract), or family connections (birth/marriage certificates).

Compliance with immigration laws

As a British citizenship applicant, you must have stayed within the immigration rules at all times during your stay. Compliance with the immigration laws means:

  • Holding valid immigration permission during the required residence period,
  • Not breaking the law, and
  • Not overstaying or breaching the terms of your visa

Any failure to comply with immigration laws may result in the refusal of your citizenship application, and it may negatively impact future applications.

Meeting language and knowledge criteria

Proficiency in the language and knowledge of life in the UK are mandatory requirements for British citizenship. You will need to:

  • Prove your knowledge of English, Welsh or Scottish Gaelic (through a recognised/approved language test at level B1, B2, C1 or C2, or by having a degree taught in English).
  • Pass the Life in the UK Test – This is designed to assess your knowledge of British traditions, history, and culture.

You must meet both of these requirements before you apply for British citizenship.

Avoiding criminal offences

Being of ‘good character’ is a key requirement for British citizenship. This means that applicants must have a clean criminal record and not be involved in any activities that could be deemed detrimental to the UK’s interests. To maintain good character, you should:

  • Avoid criminal offences, including minor infractions.
  • Be honest and transparent in all dealings with the Home Office.
  • Ensure that you have no outstanding debts or issues with the authorities.

A criminal record can significantly hinder your chances of obtaining British citizenship, so it is essential that you do all you can to abide by the law in the UK and maintain a good character throughout your residence in the UK.

As part of the ‘good character’ requirement for British Citizenship, applicants must be able to demonstrate ‘financial soundness’. For example, if you have been bankrupt in the UK, your application may be refused, but this is not always the case. British Citizenship applications will be approved with a prior history of bankruptcy if:

  • The bankruptcy order has been annulled
  • The person was discharged at least 10 years ago
  • The person was declared bankrupt abroad
  • The person was involved with a company that was liquidated over 10 years ago.
