Her application was already with the Home Office, and her sponsor never came through

Her employer never received its sponsorship allocation. She found a new sponsor, with her application already filed and biometrics eight days away.
Skilled Worker Visa
Skilled worker changing sponsor during a visa application

She had filed a Skilled Worker application without a sponsorship certificate, because her employer had not received its allocation. Then she found a new employer who could sponsor her, with a biometrics appointment eight days away.

At a glance

  • Client: Skilled Worker applicant, switching employers mid-application
  • Matter: Varying a live leave to remain application to reflect a new employer and sponsorship certificate
  • The problem: Application submitted without a sponsorship certificate; original employer never received its allocation
  • The deadline: Biometrics appointment already booked, eight days after instruction
  • Instructed: 17 September 2026

How they found us

An existing client from an earlier matter. She called us urgently: she had a job offer but no sponsorship certificate.

The challenge

  • Her application had been submitted without a sponsorship certificate, because the original employer had not received its allocation, and still had not.
  • She found a new employer who assigned one, which meant the pending application named the wrong sponsor.
  • Her biometrics appointment was already booked for the following week.
  • There was a real risk the health surcharge or application fee would have to be paid again.
  • The original caseworker was on leave at the point the problem became urgent.

What we did

  • Protected her status first. The original application was submitted before her existing leave expired, which is what preserved her lawful status while everything else was sorted out.
  • Varied rather than restarted. A new application form reflecting the new employer and sponsorship certificate, with the existing application varied rather than withdrawn and refiled.
  • Told her the risks before the biometrics date. Including the possibility of repeated fees, rather than letting her discover it afterwards.
  • Reallocated the file to hold the deadline. A second caseworker took it on when the original was unavailable.

The outcome

The application was submitted before her existing visa expired and a biometrics appointment was set.

Why it matters

A sponsorship certificate allocation is something the worker cannot control, cannot chase and often cannot see. When an employer's allocation does not arrive, it is the worker's status that is at risk. Filing to preserve leave, then varying, is the manoeuvre that buys the time to fix it.
