Why AY&J

Why AY&J Solicitors For a Revocation

  • Your notice says there is no right of appeal. It does not mention the pre-action protocol route, which is where a good number of revocations get reconsidered.
  • We run those letters as routine work rather than a last resort. You will get an honest view on whether yours is worth bringing.
Fifteen years in business immigration, more than 5,000 successful applications, and a team that deals with revocations every week. Legal 500 and Chambers ranked. Regulated by the Solicitors Regulation Authority, number 633686.

Revocation Grounds and What Can Be Argued

What your notice says

  • Paying below the rate on the Certificate of Sponsorship
  • A role that does not match the occupation code
  • Recouping sponsorship fees from a worker
  • Right to work or record-keeping failures
  • False information or falsified records

What can be argued

  • Annex C1 grounds are mandatory and much harder to shift
  • Annex C2 and C3 mean someone exercised judgement, and judgement can be challenged
  • We check whether the Home Office got the law or the facts wrong
  • Where the breach is real, we evidence what has been fixed
  • You will get a straight answer either way

FAQ

Frequently Asked Questions

Still have questions?
Contact us

Your notice

What does "sponsor licence revoked" mean?

The Home Office has permanently withdrawn your right to sponsor workers, with immediate effect. You come off the register, SMS access closes, and every Certificate you have assigned becomes invalid.

Your notice

Can they revoke without suspending first?

Yes, and it happens more often than it used to. Plenty of the revocations we see arrive with no suspension at all. Some land within a day of the sponsor sending documents the Home Office asked for.

Your notice

Which annex does my notice rely on?

It will cite Annex C1, C2 or C3 of Part 3 of the sponsor guidance. C1 is mandatory and much harder to shift. C2 and C3 mean someone exercised judgement. Send us the notice and we will tell you which you are dealing with.

Your notice

Is there a deadline to respond?

Not in the way a suspension has one, because there is nothing you are being invited to reply to. What does have a deadline is judicial review, which must be brought within three months of the decision.

Your notice

We were revoked over a salary gap. Is that common?

It is the ground we see more than any other, and it is rarely deliberate. An accountant applies the wrong going rate, or a probation arrangement pays a fraction upfront. That does not excuse it, but it does change how the case is argued.

Challenging it

Can we appeal?

There is no statutory right of appeal. The route is a pre-action protocol letter, and then judicial review in the Administrative Court if that does not resolve it.

Challenging it

What is a pre-action protocol letter?

A formal letter before claim. It sets out where the decision went wrong in law and gives the Home Office a chance to reconsider before proceedings are issued. It is faster and far cheaper than judicial review.

Challenging it

Should we email the Home Office ourselves?

We would suggest not, at least until you have taken advice. A well-meant email can concede a point you would want to argue, or fix a version of events you cannot later move away from.

Challenging it

Our accountant made the error. Does that help?

It explains what happened, which matters, though it does not by itself answer the breach. What it can affect is how the case gets framed, particularly where the ground sits in Annex C2 or C3.

Challenging it

How likely is a challenge to succeed?

That depends entirely on which annex your notice relies on and what your records show. We will read the notice and tell you honestly. If a challenge does not stand up, we will say so.

Your workers

What happens to our sponsored workers?

Their permission is normally shortened to 60 calendar days. In that window they can find a new sponsor or move to another route. Dependants follow the main applicant.

Your workers

Who tells them?

The Home Office writes to them itself, promptly, and does not say why. You will want to speak to your staff before that email lands.

Your workers

Can any of them lose their visa immediately?

Yes. Where the Home Office believes a worker knew what was going on, it cancels their permission outright rather than shortening it. They then have to leave immediately.

Your workers

How long until the curtailment letter arrives?

Longer than most people expect. Weeks in some cases, several months in others. The 60 days runs from that letter, not from the revocation.

Your workers

Can we help them find a new sponsor?

You can tell them early, which is the single most useful thing you can do. Of the care workers the Home Office signposted for support between May 2024 and April 2025, around 3% had found a new sponsor by April 2025. The ones who start early do far better.

Costs and next steps

What does it cost?

Our fee for a pre-action protocol letter and revocation representation starts at £[confirm] plus VAT, and you will know it before we start. There is no Home Office fee for the challenge itself.

Costs and next steps

How long before we can reapply?

Twelve months at minimum. That rises to at least 24 months if you have been revoked before, and reaches 5 years in certain civil penalty cases.

Costs and next steps

Can we surrender the licence instead?

Only helpfully if you move before the Home Office starts compliance action. Surrender after that point and you wait the same 12 or 24 months. You also cannot surrender while you still sponsor anyone.

Costs and next steps

Will this affect our other licences or branches?

It can. A revocation sits on your Home Office record and will be taken into account in any future application, including by connected businesses. Tell us about any related entities on the first call.

Costs and next steps

What happens on the first call?

A solicitor reads your notice, identifies the grounds it relies on, and tells you whether a challenge is worth bringing. A revocation always needs a proper consultation rather than a screening chat, so this one is chargeable.
